Kochi: The Kerala High Court on Monday flayed the police for not arresting a woman legislator in connection with an assault case.
The court rejected a police report which said there was no need to arrest CPI MLA E.S. Bijimol in connection with a case of assaulting the then Idukki ADM Moncy P. Alexander.
Justice B. Kemal Pasha observed that action should be taken against the police officer who probed the case.
Bijimol is an accused in a case which is supposed to be tried by a sessions court. Hence, it was a lapse on the part of the police not to arrest her. The state police chief himself should examine the matter, the court said.
The police had submitted a report to the court saying they have recorded the statement from Bijimol in detail and that a charge-sheet will be filed soon in the case.
The case was registered against the Peermade MLA last July after she allegedly assaulted the ADM on a private estate at Thekkemoola, near Peruvanthanam, where he had gone to implement a High Court order to maintain status quo on a complaint filed by the estate company.
