Chinmayanand checks into jail soon after discharge from hospital
Former BJP leader Swami Chinmayanand

Lucknow: Hours after his bail petition was rejected by the district court in Shahjahanpur, former Union Minister Chinmayanand was discharged from the hospital late on Monday night and sent back to Shahjahanpur jail.

Chinmayanand was shifted to the hospital just two days after his arrest on September 20 after he complained of high blood pressure and chest pain. Later, he also complained of urinary problems.

His doctors have confirmed that his condition is now normal.

Earlier on Monday, the district court in Shahjahanpur rejected the bail application of the 73-year-old leader and the law student who had accused him of sexual misconduct.

Chinmayanand has not been charged with rape. Instead, he has been charged under a sub-section of the rape law for "misusing authority for sexual intercourse".

The law student too was arrested last week on extortion charges and is in jail, presently.

Chinmayanand was recently also slapped with IPC Section 354D after it came to light that the former minister used to tear the girl's clothes whenever she resisted his sexual advances. The district government counsel Anuj Singh confirmed this as the law student's statement.

During the hearing of Chinmayanand's bail plea on Monday, the SIT also submitted that there were four persons, including the security guard of the BJP leader's ashram who confirmed that the law student used to visit 'Divya Dhaam' often.

According to the woman's complaint, she was repeatedly raped inside a room in Chinmayanand's ashram.

"In her complaint given to SIT via the Delhi Police and statement recorded under 161 and 164 CrPC, the complainant said many times that she was repeatedly raped by Chinmayanand. He used to tear her clothes whenever she refused to submit. There were several circumstantial evidence to support the allegations of the complainant, who was a student of the college and a faculty in the college's computer lab but she was asked to come to Divya Dhaam, which is not an educational facility," said Singh.

Singh further said, "We also objected to the bail application of the complainant, who is an accused in the extortion case. In both cases, there was electronic evidence against both the parties which were verified by the forensic lab."

The law student is slapped with IPC Section 385 which has maximum imprisonment of two years.
