Kochi: Another government lawyer handling the 2017 actress attack case has quit.

Special Public Prosecutor VN Anil Kumar resigned from the post. He gave resignation letter to the State Home Secretary and the Director General of Prosecution.

It was when the court took up the case on Thursday, Additional Special Public Prosecutor KB Sunil Kumar informed the court that Anil Kumar had resigned from the post.

Anil Kumar did not go public on the reasons of his resignation.

This is the second time that a Special Public Prosecutor is resigning from the post in the course of the trial in the case in which actor Dileep is an accused. Former Special Prosecutor A Sureshan had also resigned after raising serious allegations against the trial court.

Now, Anil Kumar too resigned apparently in protest against the repeated rejection of prosecution pleas by the trial court.

On Wednesday, the prosecution had sought a stay on the trial on the basis of film director P Balachandra Kumar's revelations against actor and accused Dileep and demanded further investigation. The court would consider this plea on January 4.

After submitting this particular application, Special Prosecutor Anil Kumar left the court in a huff.

Earlier, the actress had also approached the higher courts seeking shifting of the case from the present trial court.

Recently, the Kerala Government filed separate appeals in the High Court against the trial court rejection of its plea for re-examining more witnesses and its request for original phone call details. The trial court rejected the plea saying that the witnesses were examined earlier and both petitions were filed late.

The prosecution's stand is that when attempt is being made to find truth in the trial, there is no merit in denying an opportunity to bring more evidence in the case in the name of mere technicalities.

After the resignation of Anil Kumar, the trial court has asked the prosecution side to ensure necessary alternate arrangement with immediate effect so as to enable the continuance of the testimony of witnesses. The Kerala High Court has set the deadline of February 16, 2022 to finish off the trial in the case.

Being a woman judge, Honey M Varghese, who acted as CBI Special Judge, was appointed the trial court judge in the case. The High Court recently instructed the trial judge, who got transferred as Ernakulam Principal Sessions Judge, to take up the full responsibility of the new post only after finishing the trial proceedings in the actress attack case.

At present, the trial is going on against nine accused before the Ernakulam Additional Special Sessions Court (CBI Court).
