State responsible for accidents from poor road maintenance: HC

Kochi: The state of Kerala is known for is poorly maintained roads and numerous potholes.

In a significant move the Kerala High Court has said that the government and PWD will be henceforth responsible for accidents that arise on accont poorly maintained roads. The state will have to compensate anyone who might be injured on road because of poor maintenance and lack of proper caution.

The moral responsibility and onus of the negligence on the part of officials lies with the government, the court said.

The observation by Justice M Hariprasad comes in an appeal by Pandalam native Shanthamma, who sought compensation for injuries sustained on her heel when her foot got stuck in a hole on Adoor-Kaipattorr Road in December 1997. However, the appeal was rejected since she could not legally prove her claim for compensation.
