Sexual abuse case: Binoy Kodiyeri refuses to give blood sample, moves Bombay HC to quash FIR

Mumbai: Binoy Kodiyeri, son of CPM Kerala state secretary Kodiyeri Balakrishnan, has approached the Bombay High Court, seeking to quash the sexual abuse case against him.

The Mumbai Police had filed an FIR against Binoy based on a complaint by a Bihar native woman, who alleged that Binoy had sexually abused her for years under the pretext of marriage. Binoy's petition, seeking to quash the FIR, was filed on July 17. The High Court will consider it on Wednesday.

Binoy, who is out on bail, is set to appear at the police station on Monday. He has been asked to appear before the police every Monday for a month. It was also instructed that Binoy should give the blood samples for the DNA test if the cops were to ask for it. However, Binoy had refused to give his blood samples last Monday, citing health reasons.

The Mumbai Police had insisted that he should give the blood samples on Monday (July 22). Binoy then moved the High Court.

In her complaint to the Mumbai Police, the woman had said that she was sexually abused for nine years and that she had an eight-year-old child in the relationship with Binoy.

The woman had raised charges of sexual abuse, cheating, and threatening. The cops at the Oshiwara police station in Mumbai’s Andheri have registered the FIR and are probing the case.

However, Binoy had denied the allegations and said that this was an attempt to blackmail him. Though he admitted knowing the woman, Binoy claimed that her allegations were false.
