The bench held that courts must undertake a structured enquiry to determine whether the prosecution material, if accepted at face value, meets the statutory threshold under the UAPA.
The accused in the case had moved to the apex court after the Delhi High Court denied them bail on September 2.
The list of accused whose pleas were dismissed includes Athar Khan, Khalid Saifi, Mohd Saleem Khan, Shifa ur Rehman, Meeran Haider, Gulfisha Fatima and Shadab Ahmed, apart from Imam and Khalid.
The conditions for interim bail are that Khalid must not contact any witnesses or individuals connected to the case. The court has also directed Khalid not to use social media during the bail period, Live Law reported.
Khalid was arrested by the Delhi Police in September 2020
Khalid had sought bail on grounds that he neither had any criminal role in the Delhi violence nor any "conspiratorial connect" with any other accused in the case.
A bench of Justices Aniruddha Bose and Bela M Trivedi said the matter needs to heard on a non-miscellaneous day.
Khalid's petition challenging the October 18 last year order of the Delhi High Court, which had rejected his bail plea in the matter, came up for hearing before a bench of Justices A S Bopanna and Prashant Kumar Mishra.
Now the court will hear the case again on July 24.
Awaiting his trial, Khalid has been behind bars since September 2020 for his alleged involvement in the larger conspiracy over the communal violence in February 2020.
