Five accused were arrested by the NIA on October 2, 2016 from Kerala's Kannur while they were preparing to carry out terror attacks in Kerala and Tamil Nadu.
The agency arrested Vijith Vijayan, 27, who is the fourth accused in the case and a resident of Puzhamudi in Wayanad district.
In all 20 accused, including P S Sarith and Swapna Suresh, have been named in it. Crucially, the UAPA has been invoked now, though the FIR naming 31 people as accused in the case had not mentioned it.
The high court has not cancelled the bail granted to Allan Shuhaib, who was also arrested in November 2019 for allegedly supporting Maoist groups.
Political observers say Shuhaib’s entry would split anti-LDF votes and might mar the chances of UDF candidate SK Aboobaker.
The NIA has been carrying out a probe since July 9 to find out whether the smuggled gold or the money received through it was handed over to anti-national forces.
Shuhaib, a former branch secretary of the CPM, has severed ties with the ruling party in the state following the arrest of his son.
The NIA and the defendants opposed giving the transcript to the Customs Department.
The NIA probe team had informed the court the other day that it suspected that the gold smuggling case accused had terror links.
The three-judge bench of Chief Justice SA Bobde and Justices AS Bopanna and V Ramasubramanian will consider the habeas corpus plea after four weeks.
