Rajapaksa was appointed as the premier on October 26 by President Maithripala Sirisena after sacking Ranil Wickremesinghe.
The country has been in a crisis since Sirisena replaced Prime Minister Ranil Wickremesinghe with Mahinda Rajapaksa last month, and then issued an order dissolving parliament and called for a general election.
Rajapaksa and his cabinet ministers have been asked to appear in court on December 12, the judge added.
