Kochi: The Kerala High Court Tuesday rejected the bail application submitted by actor Dileep, who has been remanded in custody for allegedly plotting the February 17 actress assault case. A two-day hearing on the plea was completed last week.

Rejecting the prosecution's claims, the defense stood firm on its stand that the actor was not part of the conspiracy to attack the woman and piled up the blame on the police. They reiterated their suspicion about state director general of police (DGP) Loknath Behera as well as ADGP B. Sandhya, who oversees the investigation.

Asserting Dileep's involvement in the case, the prosecution called Dileep 'King Liar' as it handed over more documents detailing fresh evidence against the accused in a sealed cover to the court.

The prosecution presented to the court evidence to prove that main accused Sunil Kumar (Pulsar Suni) had direct links with Dileep's wife and actress Kavya Madhavan.

Arguments and counter-arguments:

Defense: How can Dileep be accused of a conspiracy with Suni just because they both were located under the same mobile phone tower at the same time? A mobile phone tower has a range of over three kilometers. It defies logic to say that the conspiracy was hatched in public as a film shoot was taking place. Why should Dileep talk to Suni in public when he has his own caravan?

Prosecution: Dileep asserts he has never seen Suni. But how can it be natural that both come under the same mobile tower frequently. There are witnesses who have seen them talk.

Defense: Why is it that Dileep and Suni never talked over the phone, if there was a conspiracy that lasted four years.

Prosecution: They have communicated several times. Suni first revealed Dileep's role to a cop on duty in the jail. Suni used the same cop's phone to call Kavya Madhavan's shop in Kakkanad.

Defense: Dileep has his own shop in Ernakulam. How is it credible then to say that Dileep asked Suni to hand over the visuals of the assault on the actress at a shop run by his mother-in-law in Kakkanad?

Prosecution: Dileep had ensured right from the beginning that Suni did not have any direct contact with him. Suni had close links with Kavya and her family. Suni has also revealed it. Kavya has also admitted to seeing him. The prime accused had visited Kavya's shop before his surrender. Once Suni drove Kavya and family to Thrissur. He has told police that he had then called Dileep from Kavya's phone to demand money. Kavya did hand over the money to Suni as directed by Dileep. Suni was a trusted man in the family.

Defense: It is unintelligent to say that the driver visited Dileep's hotel room to plot a conspiracy. Several other film personalities were at the hotel during the day. There is no authenticity about the letter that the police claim Suni wrote to Dileep from the jail. The letter has a structure and language that are different from Suni's earlier letter in which he alleges a police assault on him. The letter to Dileep was prepared as part of the plot to implicate the actor.

Prosecution: Confidential testimony that disproves the defense arguments have been submitted to the court. Fifteen people deposed in-camera as part of evidence collection. Staff members at the Thrissur Tennis Club have seen Dileep and Suni together. Details of this can be examined by the court from the secret documents.

Defense: The DGP was informed the very day main accused Suni called Dileep's aide Sunil Raj, aka Appunni. If Dileep had offered Suni Rs1.5 crore, Suni would have carried out the task immediately instead of waiting for four years. The police appear to be chasing tales that thieves cook up.

Prosecution: Dileep is a King Liar (name of the actor's movie). The accused are lying in their claim that the main evidence in the case, the mobile phone and the SIM card, were destroyed. The investigating team had solid proof of the actor's involvement in the conspiracy even before the DGP received his complaint about Suni's letter. Depositions against Dileep were also available before that. Suni had revealed to a Thrissur native about Dileep's role in the conspiracy. Suni had repeatedly tried to film scandalous visuals of the actress. There is evidence that he made the attempt in Goa also. A clever Dileep chose the most suited 'player' to play his game.

Defense: The story of a cop named Anish is a cooked-up one. Lies are being piled up to trap Dileep.

Prosecution: All details are in the case diary. It is being submitted to the court in a sealed cover. Everything cannot be revealed in the court at this stage as investigation is yet to be completed. The police team had a clear understanding of Dileep's role right from the beginning of the probe on the actress assault.
