Kochi: Malayalam director Nadhirshah, who was hoping to avert a possible arrest in the February 17 actress attack case, failed to get a reprieve from the Kerala High Court. The court ruled that it would consider his anticipatory bail plea on September 13, meaning which the police can arrest him before the set date if they want to.

The director, and his friend and actor Dileep had been grilled for nearly 13 hours by the police on June 28. Dileep was subsequently arrested on July 10 for allegedly plotting the attack.

Nadhirshah hospitalized

Soon after the police issued summons to appear before the probe team, the director sought treatment at a private hospital in Kochi. But once discharged, he would have to present himself before the police.

However, the prosecution was likely to point out that Nadhirshah was yet to be named as an accused in the case and so there was no question of granting the bail. The prosecution was likely to oppose the bail plea, citing that only one phase of the investigation was over with Dileep's arrest. More evidence needs to be gathered and for the Nadhirshah will have to be questioned, source close to prosecution said.

The young actress, who had worked in Tamil and Telugu films, was assaulted in a moving car in Kochi on February 17. Two of the key accused - Pulsar Suni and his accomplice involved in the actual abduction - were arrested a week later. The police are probing if other people from the film industry have any links to the heinous crime.

Dileep has been languishing in the Aluva sub jail near here, with three of his bail pleas rejected. Nadhirshah had recently visited Dileep at the Aluva sub jail.
