File photo: Robert Vinod Kochi: Actor Dileep's lawyer has said actress attack main accused Sunil Kumar's accusation that the superstar plotted the February 17 assault was just one of the many tales fabricated by the remanded habitual offender. The lawyer Tuesday argued in the High Court that the police theory that the actor was involved in a conspiracy with Sunil Kumar, aka Pulsar Suni, was false. The police were crucifying Dileep, based on the 'confession' of a thief.
The HC hearing will continue Wednesday on the bail plea of the actor, who has been in jail for over five weeks.
What Dileep's counsel argued:
• How can it be alleged that Dileep and Suni had entered into a conspiracy just because they had been under the same mobile phone tower at the same time? A mobile phone tower has a range of more than 3 km.
• It defies logic to say that a conspiracy was hatched in the midst of a film shoot with hundreds of people crowding around. The actor has a caravan of his own. Why then should he plot a conspiracy in public?
• The police have found nine cellphones, but they could not find a single call that was made from Suni's phone to Dileep's. If the conspiracy took four years to be executed, why wass it that not a single call was made?
• The police are just cooking up stories to get witnesses against Dileep. Suni is accused in several cases.
• The so-called letter that Suni wrote from jail to Dileep is part of an advance script. If Dileep had promised Rs1.5 crore as Suni says, would he not have paid the money to close the case.
• Witnesses in the case are linked to the assaulted actress. She had told police that there was a quotation involved, but they didn't inquire about it. They did not even ask her if she has a suspicion on anyone. This is an effort to save somebody else.
• ADGP B. Sandhya, supervising the investigation, did not allow investigating officer IG Dinendra Kashyap to handle the case.
• There had been a deliberate attempt to spark public fury against Dileep. Stories accusing Dileep of land grab, hawala etc were aired. As the allegations have been proven to be false, the massive conspiracy behind it becomes evident.
• Dileep hounded by media
• A theater owner, who has enmity towards, Dileep is capable of making strong moves
• Dileep's arrest itself is baffling. What was it for? It was not justifiable to keep Dileep in custody on the pretext that police still have to recover a cellphone that was used to film the assaulted actress after her kidnap. The lawyer demanded that police should clarify where they will recover the phone from.
